Terms and Conditions

Tours are offered by Ultimate Kiwi Sports Tours Limited. The offers are made in accordance with New Zealand Law.

Payment of deposits for a tour constitutes acceptance of these terms and conditions.

Upon acceptance by you of these terms and conditions, and with such amendments of which you may notify us in writing, we will endeavour to secure your bookings and provide you with Inclusive holiday package, accommodation and other services as detailed, subject to the following:

Our Service and Obligations

1.1) What we supply to you is the arranging and co-ordinating of your travel, accommodation, entertainment, activities and ancillary services and the making of bookings, and issuing tickets and vouchers to be redeemed by suppliers.

1.2) We undertake to perform these services with reasonable care and skill and in the recommendation or selection of carriers, accommodation and activity suppliers. We will not be liable for any loss or damage, personal injury, death, property damage inconvenience or additional costs, which results from the act, default or omission of any person other than our employees, agents, or ourselves or any cause independent of human control.

1.3) We are not able to exercise control over services we do not supply directly therefore we will not be responsible for any loss or damage arising from:

• Any booking made directly with a service supplier by another person or party

• Any services not supplied by us and are additional to those arranged by us.

1.4) We will endeavour to provide the most suitable to meet the particular requirements you made known to us. However, travel is an individual experience, and your preferences and opinion may vary from our own. For this reason. we cannot take responsibility for your individual satisfaction.

Supply of travel entertainment,
accommodation services and facilities.

2.1) When we make bookings with the suppliers of the travel, entertainment and accommodation facilities ("the suppliers") we are acting as a booking agent for the suppliers.

2.2) All travel, entertainment and accommodation facilities are supplied directly to you by the suppliers. We have no control over the facilities or services themselves, or the manner in which the Suppliers provide them. Therefore you should be aware of the following.

• We will not be liable for any loss or damage of any kind (direct or indirect, consequential or otherwise) which you may suffer resulting from our selection of those suppliers, or your use or consumption of, or inability to use or consume those facilities or services.

• The provision of those facilities or services is subject to the terms and conditions of your contract with each supplier.

• Where for any reason, a supplier is unable to provide particular facilities or services, then that supplier may be entitled, under its contract with you, to substitute those facilities or services with comparable or equivalent facilities or services without incurring any liability on you.

• All facilities or services described by us are subject to the availability from the supplier.

• We will not be responsible for any loss, damage relating to your baggage, personal possessions, health or welfare, or delays or travel disruptions unless these arise directly from the service we provide to you.

Information on this Website

3.1) While we have exercised reasonable care and skill to ensure that the contents of this website are correct, accurate and up-to-date at the time of publishing, please note the contents of this website are based on information supplied to us by the Suppliers. We do not have, and cannot be reasonably expected to have, personal knowledge about all the facilities or services provided by the supplier.

Prices

4.1) All prices shown are on a per person twin share basis and are expressed in New Zealand dollars.

4.2) Events beyond our control, such as currency fluctuations, changes to price of aviation fuel or changes to the cost of services of facilities may result in the prices or charge to you being different from those shown and we reserve the right to vary the price up to the time of your departure.

Payment

5.1) A deposit of 20% of the total price is payable at the time of booking.

5.2) Final payment date is sixty days before the scheduled date of departure, and if the booking is made less than sixty day prior to departure, on the date of booking.

Cancellations and Refunds

6.1) All cancellations should be sent by mail or email by the person who submitted the booking form.

6.2) Cancellation charges are as follows:

• More than 60 days before departure, 20% of the tour price.

• 59-40 days before departure, 30% of the tour price.

• 39-14 days before departure, 50% of the tour price.

• 14 days or less before departure 100% of the tour price.

6.3) No refunds will be made once travel has commenced: nor will any refund be available in respect of any tours, accommodation, hires, services or inclusions not utilised. We strongly recommend travel insurance cover for such eventualities.

6.4) Weather interruptions to itineraries/ tour packages are beyond our control. We will do all possible to rearrange services in such event, but cannot be held financially responsible for interruption under such circumstances.

Passports and Visas

7.1) It is your responsibility to ensure you have all the required travel documentation including, passport, visa and drivers licence.

Complaints

8.1) In the unlikely event that a problem occurs during your holiday, then it is important you inform you guide immediately. We will endeavour to do everything possible to rectify the situation.
